When and why you need a Schedule of Dilapidations or Survey

When you let a commercial property, it’s common practice to include provisions that outline a tenant’s responsibilities to the condition of your premises, to prevent the property from falling into disrepair and depreciating in value.

Known as a Schedule of Dilapidations, these reports typically outline any breaches of the Schedule of Conditions covenants written into a tenant’s lease, together with the cost for remedial or reinstatement works required to ‘put the property right’.

Having such a document is an important aspect of protecting your interests as a commercial landlord. Without a Schedule of Dilapidations in place, you have no legal recourse if a tenant fails to maintain your property or return it to its original state.

Similarly, it’s in a tenant’s best interest to have a legal representative review any ‘conditions covenants’ before agreeing to a tenancy, so they are fully aware of their legal responsibilities and the financial claims that can be brought against them.
